To the extent that any Open-Source Component is governed by an open-source license, the terms of that open-source license shall take precedence over these Terms with respect to that specific component. Nothing in these Terms shall be construed to limit any rights granted under an applicable open-source license.
10.3 No Warranty for Open-Source Components
Open-Source Components are provided "AS IS" without warranty of any kind, as described in their respective licenses. The Disclaimer of Warranties and Limitation of Liability provisions in Sections 13 and 14 of these Terms apply to the fullest extent permitted by the applicable open-source license.

The arbitration shall be conducted by a single arbitrator at a mutually agreed location. The language of the arbitration shall be English.

17.4 Class Action Waiver
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND FONSZI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
17.5 Exceptions
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
19.2 Entire Agreement
These Terms, together with the Privacy Policy and any applicable open-source licenses, constitute the entire agreement between you and Fonszi with respect to the Services and supersede all prior and contemporaneous agreements, representations, warranties, and understandings, whether written or oral, with respect to the Services.
